Previous considerations

When you make a purchase through this page and when browsing it, you accept these terms and conditions and their validity over any other buyers' terms and conditions.

As a condition to use this page as a means of purchase, the buyer: (i) confirms that all the information entered on this website or provided by email/telephone/online chat/in person is true, accurate, current and complete, (ii) is fully aware of the technical/aesthetical characteristics of the product that they are purchasing, as well as the installation and cleaning recommendations (iii) has legal authority to formalise this agreement and to use this website in accordance with all the terms and conditions specified here.

The seller reserves the right, at its sole discretion, to deny any purchase, at any time and for any reason, including the breach of this contract.

Price

Prices indicated exclude VAT and transport. The VAT and shipping cost can be calculated online or supplied by the customer service department upon request.

Payment

All stock orders are payable in full upon ordering as well as production orders up to £1000. A first payment of 50% may be accepted upon request for production orders over £1000, with the balance due prior to shipping from the factory.

Seller / Billing in the EU/EXPORT

In order to place an order from a country outside of the UK, please request a quote via E-Mail to info@mosaicfactory.com confirming the country of delivery.

The products invoiced, are subject to the VAT rate applicable in the country of delivery.

Products ordered by European companies that can provide a valid intra-European VAT certificate (VAT ID) can be invoiced without VAT (method of "intra-Community supply"). The operation is reported to the authorities on a monthly basis.

Transport and delivery

All products are manufactured in Tangier, Morocco. Traditional Mosaic SL organises shipping and importation of the goods into Spain.

The orders are then shipped from our logistics hub in Seville (Spain) to the address provided by the client using an international logistics company.

Clients may also choose their own transport company from Seville, at their own responsibility and cost.

Shipping times provided online and by our representatives are estimated and based on averages. Delivery dates cannot be guaranteed.

Standard tiles are generally packed in cardboard boxes of between 12 and 20 kg each, loaded on a protected and sealed pallet.

The transport company will notify the clients when the tiles are ready to be delivered. A delivery day should be scheduled within 5 working days from that moment or storage fees may be applied. Once a delivery date is agreed, it is the client's responsibility to ensure someone is on site to accept delivery. A specific time for delivery cannot be requested.

The delivery location must be accessible to a 12-tonne delivery lorry with tailgate and manual pallet trolley. It is the customer's responsibility to point out any restrictions: pedestrian zone, difficult access for traffic, etc.

We are not responsible for, nor do we organise, the unpacking of the pallet or the transport of the boxes to the site or upper floors.

The service does not include unpacking, special permits, porters or any additional cost due to failed deliveries or special requirements to complete the delivery (vehicle size ...).

Upon delivery

Any damage to a pallet, boxes or tiles should be documented and communicated to the customer service department within 48h. A brief description of the damage should be indicated upon signing the proof of delivery. Any claim should include photos.

Quantities will need to be verified and any missing item should be communicated to the customer service department within 48h. We reserve the right to refuse claims made after this time.

Storage costs

The maximum time that we can store a finished order for free in factory is 2 months from the date it is ready. After those 2 months, we will charge you £3/calendar day/pallet + VAT. You will be notified by email.

Returns and refunds

Returns and refunds are offered on stock tiles only, they are not applicable to custom made (production) tiles and bespoke furniture pieces.

Refunds are for the value of the tiles only, not the cost of shipping.

Returns are only accepted on unused items, unopened and undamaged boxes and tiles.

Returns need to be requested within 30 days of receiving the goods.

Returned items must be shipped back to the warehouse in Seville (Spain), at the client's expense. Please note that custom fees will be applied.

Returns need to be requested in writing, including pictures of the boxes.

For the return, the tiles must be carefully packed and placed on a sealed pallet - as they were delivered - to avoid possible damages during transportation.

The refund will be issued once the tiles have been checked upon arrival at the factory.

Measurements, quantities

Mosaic factory ® may assist clients with calculations, however, it is the buyer's sole responsibility to confirm the measurements and total quantities on the order sheet are correct. We cannot be held responsible for any discrepancies.

Sales contract

The quotation generated online or received from our customer service department acts as a sales contract and includes: images and details of the tiles ordered, quantities, financial and delivery information.

By making payment, the client accepts this sales contract and agrees to these terms and conditions.

Disclaimer

Mosaic factory ® provides general recommendations for laying and maintenance (verbally, PDF, online, videos) but its liability is strictly limited to supplying the tiles. The company cannot take responsibility for issues linked to installation, cleaning or maintenance. No returns or claims will be accepted once the tiles have been installed.

Mosaic factory ® Zellige, Terrazzo, Granito and Cement tiles show variations in tone, texture, size and finish due to the manufacturing processes and nature of the products. Each tile is unique. These characteristics are an integral part of the charm of the tiles and will not be considered valid reasons for a return/refund. It is the sole responsibility of the buyer to ensure they are familiar with the products prior to placing their order.

Limitation of liability

Except in those cases expressly described in the Legal Notice and the rest of the regulatory framework of the website, Mosaic Decor SARL is not responsible for damages of any kind that may arise from the lack of accuracy, errors or omissions of information in this website.

Communication and notifications

All communications and notifications made will be considered effective for all purposes when they are made through email to the e-mail address provided by the user. The user will keep Mosaic Decor Sarl informed of any changes that may occur in their personal information and e-mail address. The user expressly acknowledges that said data has been provided by himself and is completely true.

Information will be included in a file owned by Mosaic Decor Sarl and used to make communications about the products in which the user has shown interest, news, as well as communication of the purchase process.

The data of customers who make a purchase (except credit/debit card details), will be stored indefinitely for future use should additional tiles be required or new orders placed. Clients have the right to request the deletion of their data by sending an email to info@mosaicdecor.net where we will proceed to remove all personal data related to the order (preventing access to any information on the product purchased, should additional tiles be needed).

Intellectual and industrial ownership

Mosaic Decor Sarl is the owner of the Intellectual and Industrial property rights of the content and products shown on this website.

It is strictly prohibited to reproduce, make available to the public and in general any other form of exploitation of all or part of the contents of this website, as well as its design. These acts of exploitation may only be carried out with the written authorisation of Mosaic Decor Sarl.

Personal data protection

Mosaic Décor SARL will ensure the appropriate security measures are in place to securely store and protect the personal data provided by the user (email and contact information, name and telephone will be stored).

Users and customers may exercise at all times the rights of access, rectification, cancellation and opposition of their personal data, in accordance with the provisions of current regulations through the email info@mosaicdecor.net indicating "Delete personal data REQUEST" in the subject.

In the event that you do not wish to receive commercial information from Mosaic Decor Sarl or from the companies of the group, (MOSAIC DEL SUR and MOSAIC FACTORY brands), you can indicate it by unsubscribing (link at the bottom of any commercial communication) or by sending an email to info@mosaicdecor.net indicating "Unsubscribe" in the subject line.

Data responsibility

Applicable Law and Jurisdiction

This Legal Notice is governed and interpreted in accordance with Moroccan legislation.

The user, expressly waives any other jurisdiction that may correspond and is subject, except in cases where otherwise provided by law, to the jurisdiction and competence of the Courts and Tribunals of Tangier (Morocco) for the resolution of any disagreement that may arise from the interpretation, application and compliance of this Legal Notice, as well as the claims that may arise from any use.

Payment

The processing of payment information is managed through an external secure payment platform called HIPAY. There are anti-fraud filters and it is a payment gateway that complies with all protection and data security regulations.
